These Terms explain the agreement between you and Aisend when you use Vibecoder. They apply whether you use Vibecoder personally or for an organization.

1. Who we are

Vibecoder is operated by Aisend, trading as Vibecoder.tech, in the Netherlands. Aisend is registered with the Netherlands Chamber of Commerce (KVK) under number 78244692. In these Terms, “Vibecoder,” “Aisend,” “we,” “us,” and “our” refer to Aisend.

2. Your agreement with us

When you expressly accept these Terms, you agree to be bound by them. You must be at least 18 years old, or the minimum age required to enter into this agreement where you live.

If you use Vibecoder for a company, client, or other organization, you confirm that you have authority to bind that organization. “You” then includes both you and that organization.

3. The Vibecoder service

Vibecoder is a self-service, AI-assisted website builder. It helps you generate, edit, preview, publish, host, export, and manage websites and related project materials. Vibecoder is a software product, not a design agency, legal adviser, tax adviser, or managed development service.

We may improve, replace, or retire features as the product evolves. If a change materially reduces a paid service, we will give reasonable notice where practical and honor any rights required by law.

4. Accounts and security

Keep your sign-in details secure and provide accurate account and billing information. You are responsible for activity on your account unless it results from our failure to protect the service. Tell us promptly if you believe your account has been compromised.

One account is for one account holder or organization. You may not sell, rent, or transfer access without our written permission.

5. Plans, billing, and renewal

Vibecoder currently offers paid monthly Starter, Builder, and Pro plans. The plan price, currency, taxes, included Vibe Credits, project limit, and features shown at checkout form part of your purchase. There is no free trial unless we expressly offer one at checkout.

Subscriptions renew automatically each month until canceled. You authorize the merchant of record to charge the payment method associated with your purchase at each renewal.

An upgrade starts immediately, is charged at the full new plan price without proration or unused-time credit, and starts a new monthly billing cycle. A downgrade starts at your next renewal. If the new plan has a lower project limit, you choose which projects stay editable; the rest become read-only and are not immediately deleted.

You may cancel renewal at any time. Your paid plan remains available through the end of the current paid period. Ordinary cancellation stops future renewal and does not itself create a refund, except where required by law.

6. Vibe Credits

Vibe Credits measure eligible AI and build work performed in Vibecoder. The amount used can vary with the work requested. Credits have no cash value, cannot be transferred, and cannot be used outside Vibecoder.

Included credits refresh at each monthly renewal and replace any unused included balance; they do not roll over. Purchased credits do not expire while your account is retained, but an active paid plan is required to use them. The current top-up quantity and price are shown before purchase.

If a credit purchase is refunded, reversed, disputed, or charged back, we may remove the associated credits or adjust the account by the equivalent amount. Deleting your account permanently removes all remaining credits.

7. Projects, hosting, and domains

Your plan determines how many projects can be edited at once. Read-only projects remain available to view, export, delete, or move back into an editable slot where the product permits.

When paid entitlement ends, published websites and connected custom domains ordinarily remain live for 14 days. We may then show a neutral paused page. We aim to warn you about 48 hours before that pause. We may suspend a site sooner where necessary for abuse prevention, security, legal compliance, or unusually costly or harmful traffic.

Projects are ordinarily retained in read-only form for 90 days after paid entitlement ends and may be permanently deleted after that period. Export anything you need before the retention period ends. Exports include the latest customer-owned code and assets available through the product, but not secrets, credentials, or Vibecoder's internal systems.

Custom domains may also be subject to registrar, DNS provider, registry, or other third-party terms and fees. You are responsible for maintaining rights to domains you connect.

8. Your content and generated output

You retain ownership of content, code, data, branding, and other materials you provide. Aisend does not claim ownership of the generated output in your projects. To the extent Aisend has any rights in that output, Aisend assigns those rights to you, subject to applicable law and any third-party, open-source, font, image, stock-media, or similar licenses.

You give us a limited license to host, copy, process, display, transmit, and modify your content only as needed to provide, secure, support, and improve the operation of Vibecoder for you. To provide AI features, we may send relevant instructions, project content, and context to third-party AI providers. Depending on the provider and configuration, those providers may retain or use submitted data to operate, improve, or train their services under their own terms and privacy practices.

You confirm that you have the rights needed for content you upload or instruct Vibecoder to use. Remove content if you no longer have those rights.

9. AI-generated work requires review

AI output can be incomplete, inaccurate, non-unique, insecure, or unsuitable for your purpose. It may contain bugs or resemble material produced for others. You are responsible for reviewing and testing a website before relying on or publishing it, including its accessibility, security, claims, content, licenses, privacy notices, and legal compliance.

Vibecoder does not guarantee that generated output can be registered, protected, or used without third-party rights.

10. Third-party services and materials

Vibecoder may connect to third-party services or use open-source software, models, fonts, images, and other materials. Their own terms and licenses may apply. We are not responsible for a third-party service's availability, acts, or changes, but this does not limit any responsibility we cannot exclude by law.

You decide whether to connect a third-party account and are responsible for its credentials, configuration, and charges.

11. Payments on websites you build

A payment integration added to a generated website is separate from Vibecoder's own subscription and Vibe Credit billing. If you sell products or services through a site you build, you—not Aisend—are the seller or merchant for your customers unless a separate provider expressly says otherwise.

You are responsible for your customer terms, product claims, fulfillment, refunds, taxes, privacy obligations, disputes, and compliance with payment-provider rules and applicable law.

12. Acceptable use

You may not use Vibecoder to:

  • break the law, facilitate fraud, or violate another person's rights;
  • create or distribute malware, phishing, credential theft, spam, or deceptive impersonation;
  • exploit, probe, overload, bypass, or interfere with Vibecoder or its security and usage controls;
  • upload highly sensitive data that the service is not designed to handle;
  • resell or provide access to Vibecoder except through features and plans that expressly permit it; or
  • use the service to develop or operate content or activity that creates a serious risk of harm.

We may investigate suspected misuse and take proportionate steps to protect users, third parties, and the service.

13. Failed payments, suspension, and termination

If a subscription payment fails, we ordinarily provide a three-day payment grace period. If payment is not restored, editing can become unavailable and projects become read-only. Paid access is restored after payment is confirmed, subject to any project limits on the active plan.

We may restrict or terminate access sooner for serious or repeated breaches, fraud, security threats, unlawful activity, non-payment, or harm to the service or others. Where reasonable, we will give notice and an opportunity to fix the issue. You may stop using Vibecoder at any time and may delete your account from the Account Center.

14. Refunds and statutory withdrawal rights

Nothing in these Terms limits a cancellation, withdrawal, refund, conformity, or other consumer right that applicable law does not allow us to limit.

Where applicable law gives you a statutory right to withdraw from a purchase, you may exercise it within the applicable period by emailing info@vibecoder.tech from your account email address and identifying the purchase. We and the merchant of record will process any refund required by law.

Outside mandatory legal rights, refund requests are assessed under these Terms, the details shown at checkout, and the merchant of record's applicable refund rules. Canceling a subscription renewal is different from exercising a statutory withdrawal right.

15. Platform payments

Vibecoder subscriptions and Vibe Credit purchases are sold through Stripe Managed Payments. The merchant of record named at checkout—currently Link—handles the payment transaction, applicable transaction taxes, transaction documents, and payment refunds under its terms. Aisend remains responsible for providing Vibecoder and product support.

Your checkout may show local currency, tax, payment methods, and merchant information based on your location and purchase. The final checkout details control if they differ from a marketing display.

16. Availability and warranties

We work to keep Vibecoder reliable, but software and AI systems can fail or be unavailable. To the maximum extent permitted by law, Vibecoder is provided without a promise that it will always be uninterrupted, error-free, or suitable for every purpose.

This section does not reduce mandatory consumer guarantees or statutory conformity rights that apply to you.

17. Liability

Nothing in these Terms limits liability where the law does not allow it. If you are a consumer, your mandatory legal rights remain unaffected.

If you use Vibecoder for business purposes, neither party is liable, to the extent permitted by law, for indirect losses or loss of profit, revenue, goodwill, business opportunity, or data. Aisend's total liability relating to Vibecoder is limited to the amount you paid for the service during the 12 months before the event giving rise to the claim.

18. Business-user responsibility

If you use Vibecoder for business purposes, you will defend and reimburse Aisend against third-party claims and reasonable costs arising from unlawful content you provide, your breach of another person's rights, or products and services you sell through a generated website. This does not apply to the extent a claim was caused by Aisend.

19. Changes to these Terms

We may update these Terms to reflect product, legal, security, or business changes. We will post the new version and effective date. If a change materially affects existing users, we will provide reasonable notice and request renewed acceptance where appropriate. Changes do not retroactively remove rights already earned.

20. Applicable law

These Terms are governed by Dutch law. If you are a consumer, this does not limit any mandatory protections you have under the law of your country of residence.

21. General terms

You may not transfer this agreement without our consent. We may transfer it as part of a reorganization, sale, or transfer of Vibecoder, provided your rights are not materially reduced. If one provision is unenforceable, the remaining provisions stay effective. A delay in enforcing a right is not a waiver of that right.

These Terms and the purchase details shown at checkout form the agreement for your use of Vibecoder, together with any other policy or addendum that expressly says it forms part of that agreement.
